There will come a time for every Landlord when you wish to take possession of a property you are letting out. You may wish to take possession of your property because you want to sell it, you are no longer happy with the Tenants or you simply wish to make alterations to you property.
If you are a Landlord who has an Assured Shorthold Tenancy (AST) agreement and you wish to take back possession of the premises you can do so with a Section 21(a) Notice Requiring Possession.
A Section 21(a) Notice does not require you to give specific grounds for wanting to take possession of the property, so whatever your reasons a Section 21(a) Notice will be suitable. However, there are some restrictions to the situations in which you can serve a Section 21(a) Notice on your Tenants.
Periodic or fixed term tenancy?
Only periodic tenancies are capable of being terminated by serving a Section 21(a) Notice. A periodic tenancy is one which does not have a definitive length of time, it continues until such a time that either the Landlord or Tenant(s) actively terminate the agreement.A Section 21(a) Notice cannot be used during a fixed term tenancy, i.e. tenancies that run for a fixed length of time. However, once a fixed tenancy ends it will automatically be converted to a periodic tenancy unless a further fixed term is agreed upon by yourself and the Tenants.
Responsibilities of Landlords
A notice period of 2 months must be given to Tenant(s) and it is necessary that the Notice expires on the last day of a tenancy period.If you do not understand or follow the necessary procedures then you will not be able to take possession of the property. It is therefore important to follow the law carefully.
