Requirements for a general AST to be created

  • your Tenant must be a private individual, i.e. not a company or business
  • the dwelling must be separate accommodation, so you cannot live in the same accommodation as your Tenant(s)
  • the dwelling must be your Tenant(s) main home; holiday or business lets are not capable of ASTs
  • the initial fixed term cannot exceed 3 years
  • rent must be paid, however it cannot exceed £100,000 per year
  • the property cannot contain more than 2 acres of agricultural land
  • the tenancy must have been created after 1989


Why have a specific AST agreement?

When you choose to be a Landlord there are many decisions to be made. One important decision is whether you will let your property furnished or unfurnished. Both are valid choices which have positives and negatives attached to them. It is important to have a tenancy agreement in place which reflects the type of let you have to offer.

If you choose to let your property unfurnished your Tenant(s) will provide their own furnishings. This means you will have no responsibility to provide, renew or replace any furniture. The Tenant(s) will be afforded the right to furnish the property however they wish, so long as the furnishings do not impact negatively on the property.

Similarly if your property does not have a garden there will be no issue of who is responsible for its maintenance.

A specific AST agreement will reflect the lack of furniture and garden as there will be no need to include clauses relating to either of these aspects.

How to create an AST

Creating an AST is easy. However, creating a tenancy agreement which covers all aspects that might be required is a massive undertaking. If you do not have extensive legal knowledge it is likely that you will not think of everything that needs to be included. On the other hand solicitor's fees can be very expensive.
