Section 8 Notice

Unfortunately there are times when a Landlord needs to terminate a tenancy agreement because the Tenant(s) have breached one or more of the Tenancy conditions. This is not a pleasant situation but can be handled professionally and legally, ensuring that the Landlord can take possession of the property in accordance with the law.

If you are a Landlord in this position you can serve a Section 8 Possession Notice on the Tenant(s). This not only gives the Tenant(s) notice that you wish to take possession of the property, it also gives you the grounding to take the matter further and obtain a possession order from the court if required.

Is a Section 8 Notice restricted to a certain type of tenancy? The Section 8 Notice can be served on Tenant(s) with an assured Tenancy or Assured Agricultural Tenancy. Unlike a Section 21(a) Notice, the Section 8 Notice is not restricted to Assured Shorthold Tenancies (AST). The only requirement is that the Tenant(s) have breached the conditions of the tenancy agreement.

What constitutes a breach of conditions?

The Housing Act 1988 prescribes 17 grounds under which a Landlord may serve a Section 8 Notice. The most common of these grounds relate to the failure to pay rent. However, there are also grounds which relate to the condition of the property and/or furniture, people living at the property without permission, Tenant(s) providing false information and issues of violence between Tenants. The required Notice period will depend on which grounds are being cited as the breach. Notice periods range from 2 weeks to 2 months so it is important to understand how much notice you are legally required to give your Tenant(s).
